RP Busz Travel Kft. operates the online store under the BonVoyageMonkeys brand.
2. SCOPE OF THESE TERMS
These Terms apply to purchases made through the BonVoyageMonkeys online store, in particular to digital travel guides supplied electronically and not on a tangible medium. Additional information displayed on a product page forms part of the information provided in connection with the relevant product.
If you purchase as a consumer, mandatory consumer-protection rules applicable to you remain unaffected.
3. OUR DIGITAL TRAVEL GUIDES
BonVoyageMonkeys travel guides are digital information products created to help travellers plan and enjoy trips independently. Depending on the guide, content may include destination information, beaches, hotels and accommodation suggestions, restaurants, cafés, attractions, activities, itineraries, maps, practical tips and other travel recommendations.
Unless expressly stated otherwise, the purchase relates to digital content only. No physical copy is supplied.
4. INFORMATION MAY CHANGE
Travel information can change quickly. Prices, opening hours, transport schedules, entry requirements, availability, menus, accommodation standards, attractions, local rules and other circumstances may change after a guide is prepared or updated. We aim to provide useful and carefully researched information, but we cannot guarantee that every third-party detail remains current at the time of your trip.
You remain responsible for checking information that is material to your trip directly with the relevant hotel, restaurant, transport operator, attraction, authority or other provider before relying on it, particularly visa and entry requirements, health and safety requirements, transport schedules, opening hours and reservations.
5. ORDERING AND CONTRACT FORMATION
Product descriptions and prices are displayed in the online store. Before submitting an order, you are responsible for checking the selected product and the information entered at checkout.
The contract is concluded when your order is accepted and confirmed through the online store. We may refuse or cancel an order where permitted by law, including in cases of obvious pricing or technical errors, suspected fraud or payment failure. If payment has already been taken for an order that is validly cancelled by us, the relevant amount will be refunded.
6. PRICES, TAXES AND PAYMENT
Prices are displayed in the currency shown in the online store and include or exclude taxes as indicated at checkout and as required by applicable law. Available payment methods are displayed during checkout.
Payment is processed through Shopify and/or the payment service providers made available at checkout. We do not generally receive or store complete payment-card details.
7. DELIVERY AND ACCESS TO DIGITAL CONTENT
After successful payment and order confirmation, the purchased guide will be supplied or made accessible electronically in the manner indicated during checkout or in the order confirmation, for example through a download link, customer account or email.
You are responsible for providing a valid email address and for having a device, internet connection and software reasonably capable of opening the file format indicated for the product.
If you experience a genuine technical problem accessing a purchased guide, please contact us at bonvoyagemonkeys@gmail.com.
8. PERSONAL LICENCE - ONE PURCHASE, ONE PURCHASER
A purchase does not transfer ownership of the Travel Guide, copyright or any other intellectual property right to you.
Subject to payment of the applicable price and compliance with these Terms, we grant the individual purchaser a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access and use the purchased Travel Guide solely for the purchaser’s own private, non-commercial use.
ONE PURCHASE GRANTS A LICENCE TO ONE PURCHASER ONLY. The Travel Guide is not a group, household, family, company or travel-party licence. Another person who wishes to access or use the Travel Guide must purchase their own copy unless we expressly offer a different licence in writing.
9. STRICT PROHIBITION ON SHARING, COPYING AND REDISTRIBUTION
You must not share, forward, distribute, reproduce, publish, upload, resell, sublicense or otherwise make the Travel Guide, or any substantial part of it, available to another person without our prior written permission.
In particular, without our prior written permission, you must not:
send or forward the Travel Guide or its download link to friends, family members, travel companions, colleagues or any other third party;
share the Travel Guide through email, WhatsApp, Messenger, Telegram, AirDrop or any other messaging, communication or file-transfer service;
upload the Travel Guide to Google Drive, Dropbox, iCloud or another cloud-storage location in a way that allows another person to access it;
upload, publish or distribute the Travel Guide on a website, social-media platform, forum, group, online community, file-sharing service or marketplace;
copy, reproduce, scan, photograph, screenshot, screen-record, print or otherwise reproduce all or a substantial part of the Travel Guide for another person’s use;
sell, resell, rent, lend, sublicense, exchange or otherwise commercially exploit the Travel Guide;
use the Travel Guide or substantial parts of it to create, compile or market a competing travel guide, database, itinerary product or other commercial content;
remove, hide, crop, obscure or alter a copyright notice, watermark, purchaser identifier, order number or other rights-management information included in the Travel Guide; or
circumvent or attempt to circumvent technical measures used to protect the Travel Guide or restrict access to it.
The fact that no payment is requested from the recipient does not make sharing permitted. Unauthorised sharing with even one other person may constitute a breach of these Terms and, depending on the circumstances, an infringement of intellectual property rights.
10. INTELLECTUAL PROPERTY
Unless otherwise indicated, BonVoyageMonkeys Travel Guides and the original material contained in them, including text, photographs, graphics, illustrations, maps, itineraries, recommendations, selections, compilations, structure, layout and design, are owned by or licensed to RP Busz Travel Kft. and are protected by applicable copyright and intellectual-property laws.
All rights not expressly granted under these Terms are reserved. No provision of these Terms grants you any right to use the BonVoyageMonkeys name, logo, branding or other protected material for commercial purposes.
11. PERSONALISED COPIES, WATERMARKS AND RIGHTS MANAGEMENT
Where technically available, a purchased copy may contain information identifying the purchaser or transaction, such as the purchaser’s name or email address, order number, licence notice, watermark or similar rights-management information.
Such information may be used to identify the copy as licensed to the relevant purchaser and to deter or investigate unauthorised distribution. You must not remove, conceal or alter such information.
Any processing of personal information for these purposes is carried out in accordance with our Privacy Policy and applicable data-protection law.
12. SUSPECTED UNAUTHORISED USE AND ENFORCEMENT
Where we reasonably suspect unauthorised access, copying, sharing, distribution, resale or other misuse, we may, to the extent permitted by applicable law and where proportionate:
investigate the suspected misuse;
request information reasonably necessary to clarify the circumstances;
restrict, suspend or terminate access to the affected digital content or download link;
take reasonable technical measures to prevent further unauthorised access or distribution; and
take appropriate steps to protect or enforce our contractual and intellectual-property rights.
Termination or restriction of access resulting from a material breach of these licence conditions does not grant a right to a refund where a refund is not required by mandatory law. We reserve the right to seek available legal remedies in the event of infringement. Nothing in this Section limits mandatory consumer rights.
13. CONSUMER RIGHT OF WITHDRAWAL AND IMMEDIATE DIGITAL DELIVERY
Consumers generally have a statutory right of withdrawal from distance contracts. Special rules apply to digital content that is not supplied on a tangible medium.
Where you request immediate access to a paid Travel Guide before the end of the applicable withdrawal period, we will ask you to provide the prior express consent and acknowledgement required by applicable law. Where all statutory conditions are satisfied and performance begins, you may lose your statutory right of withdrawal in relation to that digital content.
The checkout or purchase process should therefore include a separate, affirmative statement substantially to the following effect:
“I expressly consent to the immediate supply of the digital content before the end of the withdrawal period and acknowledge that, once performance begins in accordance with applicable law, I lose my statutory right of withdrawal.”
The above consent must not be treated as given merely because you accept these Terms. Where required by law, it must be obtained separately and expressly, and the relevant confirmation must be provided to you on a durable medium.
Nothing in these Terms removes any withdrawal, conformity, refund or other consumer right that cannot lawfully be excluded.
14. REFUNDS, DEFECTS AND CONFORMITY
Because our products are digital content, refunds are not available merely because you changed your mind after lawful immediate supply has begun and your statutory right of withdrawal has been validly lost.
This does not affect rights you may have where the digital content is not supplied, is defective, does not conform to the contract, or where applicable law otherwise requires a remedy or refund.
If you believe that a guide has not been delivered correctly or there is a genuine technical or conformity issue, contact us at bonvoyagemonkeys@gmail.com with your order details so that we can investigate.
15. THIRD-PARTY BUSINESSES, SERVICES AND LINKS
Travel Guides may mention or link to hotels, restaurants, attractions, transport operators, tour providers, booking platforms and other third parties. Unless expressly stated otherwise, these third parties are independent from us.
A recommendation or mention does not make us the supplier of the third party’s goods or services and does not create a guarantee regarding availability, quality, safety, price or performance. Any booking or transaction with a third party is governed by the terms applicable between you and that third party.
Where content is sponsored, affiliated or otherwise commercially connected, we will make disclosures where required by applicable law.
16. TRAVEL RESPONSIBILITY AND NO PROFESSIONAL ADVICE
Our Travel Guides are intended as general travel information and inspiration. They do not constitute legal, immigration, medical, safety, financial or other regulated professional advice.
Travel involves risks and personal decisions. You are responsible for assessing whether a destination, activity, accommodation, restaurant, transport option or other recommendation is appropriate for you and for complying with applicable laws, official travel requirements and safety instructions.
17. LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including mandatory consumer-protection rules.
Subject to the preceding sentence, we are not responsible for acts or omissions of independent third-party providers, or for changes to third-party prices, schedules, availability, opening hours, entry rules or other information occurring after the relevant content was prepared or updated.
We do not guarantee that use of a Travel Guide will result in a particular travel experience, availability, price or outcome.
18. CUSTOMER OBLIGATIONS
You agree to provide accurate information when placing an order, use the Services lawfully, keep account and access credentials secure, and comply with the licence and intellectual-property restrictions in these Terms.
You must not use the website or digital content in a manner that infringes the rights of another person, interferes with the operation or security of the Services, or violates applicable law.
19. PRIVACY
Personal information is processed in accordance with our Privacy Policy. The Privacy Policy explains, among other matters, how we process information connected with orders, access to digital content, security, fraud prevention and the protection of our intellectual-property rights.
20. CHANGES TO THESE TERMS
We may update these Terms from time to time for future purchases to reflect changes to our Services, business practices or applicable law. The version applicable to your purchase is the version made available in connection with that purchase, subject to any changes required by mandatory law.
21. GOVERNING LAW AND CONSUMER RIGHTS
These Terms and contracts concluded with RP Busz Travel Kft. are governed by Hungarian law, without prejudice to mandatory consumer-protection provisions that apply to consumers under the law of their country of habitual residence where such provisions cannot be derogated from by agreement.
Nothing in these Terms deprives a consumer of the protection afforded by mandatory provisions of applicable law or of any right to bring proceedings before a court that has jurisdiction under applicable law.
22. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. An invalid provision will not be interpreted so as to deprive a consumer of mandatory statutory rights.
